1Platform Role & Scope
StartCloudOps ("the Platform") is a technical interface that enables businesses to manage their WhatsApp Business API communications. StartCloudOps acts solely as a technology and infrastructure provider and does not provide, resell, or control WhatsApp messaging services.
2Fees & Payment Structure
You agree to pay the applicable fees for access to the StartCloudOps dashboard, automation tools, and technical services as described in your plan.
Meta WhatsApp Charges: All WhatsApp-related message, conversation, and template charges are determined and billed directly by Meta Platforms, Inc. StartCloudOps does not collect, manage, or refund Meta charges.
Refund Policy
All platform fees paid to StartCloudOps are non-refundable once service access is granted, except where required by applicable law.
3Meta & WhatsApp Compliance
Your use of the Platform is strictly subject to the WhatsApp Business Messaging Policy and WhatsApp Commerce Policy.
- You agree not to send spam, fraudulent, or harassing messages.
- You must obtain proper opt-in consent from your customers before messaging them.
- Meta reserves the right to block your phone number or ban your WABA account for policy violations. StartCloudOps cannot overturn Meta's decisions.
4Account Suspension & Termination
We reserve the right to suspend or terminate your access to StartCloudOps immediately, without prior notice or refund, if:
- You violate these Terms or Meta's policies.
- You use the platform for illegal activities or spam.
- You fail to pay applicable StartCloudOps platform fees.
- Your actions compromise the security or stability of our infrastructure.
5Service Modifications
We reserve the right to modify, update, or discontinue any part of the platform at any time to improve functionality, security, or compliance.
6No Guarantee of Delivery or Results
StartCloudOps does not guarantee message delivery, delivery speed, response rates, or business outcomes. Message delivery and availability depend on Meta Platforms, Inc. and other third-party providers.
7Limitation of Liability
To the maximum extent permitted by law, StartCloudOps shall not be liable for:
- Third-Party Actions: Bans, restrictions, or downtime imposed by Meta Platforms, Inc. or WhatsApp.
- Lost Profits/Data: Any indirect, incidental, or consequential damages arising from your use of the service.
- Service Interruptions: Downtime caused by upstream providers (Meta API, Cloud Hosts).
Our total liability for any claim shall not exceed the amount you paid to StartCloudOps in the past 3 months.
8Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Courts located in India shall have exclusive jurisdiction.
